EV-Cars Car Rental – Terms & Conditions

1. Parties to the Agreement

Renter – a private individual or business entity (e.g. company, foundation) entering into a rental agreement and meeting the conditions below:

For private individuals:

• Minimum age: 21 years (or 26 years for sports cars)

• Holding a valid driving license for at least 1 year (3 years for sports cars)

For businesses:

• The designated vehicle user must meet the above conditions

2. Rental Period

• Minimum rental period: 1 day (24 hours)

• Maximum standard period: 30 days (unless agreed otherwise)

3. Renter Obligations & Restrictions

The Renter agrees to:

• Use the vehicle in compliance with traffic laws

• Protect the vehicle's documents and keys from third parties

• Carry valid documentation while driving

• Notify EV-Cars immediately of any breakdown, damage, or incident

• Return the vehicle:

  • With a full fuel tank (or minimum 80% battery charge for EVs)

  • Clean (fees apply if not: external wash from 70 PLN, interior cleaning from 70 PLN)

• Install any child seat personally

• For long-term rentals: have the vehicle checked monthly at a designated garage

• Cover fines, parking fees, towing costs, and traffic violations

It is strictly prohibited to:

• Perform any repairs, modifications, or install extra equipment

• Tow other vehicles

• Transport animals (penalty: 500 PLN)

• Exceed 140 km/h speed limit

• Use the car in races, drifting, or on racetracks/training tracks (penalty: forfeiture of deposit + up to 5000 PLN)

• Smoke or vape in the vehicle (penalty: 500 PLN)

• Leave Poland without written consent (penalty: forfeiture of deposit + 2000 PLN + return costs)

Additional charges (gross):

• Missing fuel/charging: refuel cost + 50 PLN handling fee

• Lost documents: 320 PLN

• Lost keys: 1600 PLN

• Lost equipment (e.g. chargers, hubcaps): manufacturer's price + 10%

• Wrong fuel: 700 PLN

• Damage from misuse: parts + labor

• Upholstery cleaning: 500 PLN

4. Vehicle Return

• Return by the time specified in the agreement

• Vehicle must be returned in clean and undamaged condition

• Notify EV-Cars 60 minutes before return

• Extension possible only with EV-Cars approval

• Unauthorized extension results in:

  • Forfeiture of deposit

  • Additional charge: 200% of daily rate per extra day

5. Rental Fees and Terms

• Rates follow EV-Cars' current price list

• No refund for early return unless approved due to exceptional circumstances

• After-hours pickup/return fee: from 100 PLN

• Daily mileage limit: 500 km (unless stated otherwise)

• Payment methods: cash, debit/credit card, BLIK, Revolut (503 833 256)

6. Security Deposit

• Deposit: 500–5000 PLN (based on vehicle class)

• Refundable after successful vehicle inspection

• May be withheld if rules are breached

• EV-Cars may use GPS to track the vehicle (used only in case of contract breach)

7. Renter Responsibility

• Late return without approval: 200% daily rate per day

• Renter covers fuel, operating fluids, and wear parts

• Renter is liable for all damages occurring during the rental period

8. Insurance & Damage

• All vehicles are covered by liability and roadside assistance insurance

• All damage must be reported with documentation

• Option to reduce deductible: +50% rental rate, deposit cut by 50%

• Standard deductible: up to 5000 PLN

• In case of total loss: up to 10,000 PLN or vehicle value difference

• Extreme use (racing, off-road) strictly forbidden – full liability for misuse

9. Traveling Abroad

• Cross-border travel allowed only with written EV-Cars consent

• Approved countries: Germany, Czech Republic, Slovakia, Austria, Hungary, Belgium, Netherlands, Croatia, Slovenia, Italy

• Consent fee: 300–500 PLN (depending on vehicle class/rental period)

• International assistance insurance required

• Unauthorized travel: 2000 PLN penalty + deposit forfeiture + recovery costs

10. Final Provisions

• Renter pays for towing due to illegal parking

• EV-Cars reserves the right to refuse rental without reason

• Personal data is processed under GDPR compliance

• In case of contract breach, data may be shared with authorities

• Legal disputes shall be settled by the court of EV-Cars' registered office

• Mediation may be considered before legal action
